Effective date: 8 July 2026 · Version 1.0
SelectivePath (the "Service", "we", "us", "our") is operated by [Registered business name], ABN [ABN], of [Business address]. You can contact us at [contact email].
By creating an account, ticking the agreement box, or otherwise accessing or using the Service, you agree to these Terms of Service and the policies referred to above. If you do not agree, you must not use the Service.
You may create profiles for children in your care. By doing so you confirm that you are their parent or legal guardian and that you consent, on their behalf, to their use of the Service and to our handling of their information as described in our Privacy Policy. Each student signs in only with the username and PIN you set, and can access only their own exam and results.
The Service offers online practice tests, automated (AI-assisted) writing feedback, and progress analytics to help prepare for the NSW Selective High School Placement Test, the Opportunity Class (OC) Placement Test, and NAPLAN. The Service is for preparation and practice only.
Plans are offered per child and may include free and paid (subscription) tiers. Paid subscriptions are billed in Australian dollars and renew automatically until cancelled. Full details, including cancellation and refunds, are in our Billing & Refund Policy.
All content on the Service — including questions, answers, worked solutions, writing prompts, text, design, software and analytics — is owned by us or our licensors and is protected by copyright and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the content solely for your own and your children's personal, non-commercial study. You must not copy, reproduce, publish, distribute, sell, licence, scrape, data-mine, or create derivative works from any part of the Service, except as expressly permitted. See our Acceptable Use Policy.
You (or your child) retain ownership of the writing responses submitted for feedback. You grant us a licence to store and process those responses to provide the Service (including marking and displaying results to you). To generate writing feedback, responses are processed by a third-party AI provider (Anthropic). Feedback is automated and may contain errors — it is a study aid, not a definitive assessment. Do not include sensitive personal information in writing responses.
You must use the Service lawfully and in accordance with our Acceptable Use Policy, which is incorporated into these Terms. Breaching it may result in suspension or termination.
The Service is provided on an "as is" and "as available" basis. We aim for high availability but do not guarantee the Service will be uninterrupted or error-free, and we may add, change, suspend or remove features.
We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. You may stop using the Service and close your account at any time. Some provisions (including intellectual property, disclaimers and limitation of liability) survive termination.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (ACL), that cannot lawfully be excluded. Our goods and services come with guarantees that cannot be excluded under the ACL.
To the maximum extent permitted by law, and subject to the consumer guarantees above, we are not liable for any indirect, incidental, special or consequential loss, or loss of profits, data or opportunity. Where our liability cannot be excluded but can be limited, our liability is limited (at our option) to re-supplying the relevant service or paying the cost of having it re-supplied.
We handle personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).
We may update these Terms from time to time. If we make material changes we will take reasonable steps to notify you (for example, by email or a notice in the Service). Continuing to use the Service after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of [State — e.g. New South Wales], Australia, and you submit to the non-exclusive jurisdiction of its courts.
